Practice areas. One of them is yours.

Criminal defense in Dane County and the surrounding counties of south central Wisconsin.

Drunk driving / OWI / DUI

Defending DUI cases has always presented special challenges. In Wisconsin, due to statutory changes and more sophisticated blood alcohol-testing technologies, mounting a successful defense is difficult, but there are aspects of the arrest and charge that can be challenged.

    Drug crimes

Drug charges include misdemeanors and felonies, and range from simple possession; possession with intent to deliver; and manufacture, distribution or delivery.

    Sex offenses

A conviction may carry mandatory prison time and lifetime registration as a sex offender.

    Computer crimes

Because computers are frequently shared, computer forensic examinations may be necessary.

    Property crimes / Theft

Theft is taking something that doesn't belong to you, whereas a robbery is taking something from a person and using force, or the threat of force, to do it.

    Fraud

Fraud is the knowing use of dishonesty and deception in order to achieve some sort of gain, usually (though not always) financial.

    Battery and assault

In many of these battery or assault cases, there is the possibility of significant prison time and the potential to affect your future employment and education goals.

    Wisconsin Statute 940.19
    940.19(1)
    Misdemeanor battery
    940.19(2)
    Substantial battery, felony severity I
    940.19(4)
Great bodily harm with intent to cause bodily harm, felony severity H
    940.19(5)
Great bodily harm with intent to cause great bodily harm, felony severity E
    940.19(6)
Intentionally causing bodily harm by conduct with risk of great bodily harm, felony severity H

Also defended: domestic violence · restraining order violation · traffic offenses and license reinstatement · disorderly conduct.

    What the charge
    can mean.

As the firm's practice page explains, Wisconsin offenses are classified as misdemeanors, felonies or criminal traffic. A crime punishable by imprisonment in the Wisconsin prisons is a felony.

In Wisconsin, first-offense OWI is a civil forfeiture, not a crime. The firm's overview also explains that a felony conviction forfeits the right to vote, to hold office, to sit on a jury and to own a gun.

    In the news.

A probation sentence on a reckless endangerment charge.

Madison.com reported that Judge David Flanagan stayed a prison sentence and placed a Sun Prairie man on probation after he fired at cars on the Beltline. Nagel argued that the man had set out to die that night, possibly in a suicide by police officer, and recovered his will to live after a series of serious mistakes.
